ZamWays No Delivery & Shipping Policy.

Zamways Uniserv Pvt. Ltd. / ZamWays ("the Company") operates as a Retail Commerce platform that connects local users ("Users") with local merchants or retailers ("Merchants"). By using the ZamWays platform, both through the website and mobile application, Users can search for and locate nearby Merchants or retailers offering various products and services across more than 100 retail categories. However, it is important to clarify that ZamWays does not provide any delivery/shipping services for products or services purchased by users through the platform. This document outlines the "No Delivery" policy and details the terms and conditions governing the Company’s role and limitations in transactions between Users and Merchants.

1. Platform Role and Functionality

ZamWays acts solely as a facilitator and digital platform designed to help Users find local Merchants within a specific geographic location. ZamWays provides an intuitive process for Users to:

  • Location Selection: Users can input their location into the app, enabling the platform to tailor search results to nearby Merchants.
  • Product/Service Search: Users can search for products / services, or Merchants in their vicinity based on category or specific needs.
  • Store Navigation: Upon identifying a Merchant, ZamWays provides directions to help Users visit the physical store.

ZamWays' function is limited to facilitating the discovery of local retail outlets and does not involve itself in the delivery, handling, or transport of goods, services purchased at these Merchants. All transactions resulting from the connection made between the User and the Merchant occur directly between the two parties.

2. No Delivery Option

ZamWays does not provide delivery services for any of the products or services listed on its platform. Users are required to physically visit the merchant's store or retailers to make their purchase, collect their items, or avail themselves of any services. The entire responsibility for delivery, if offered, lies with the Merchant, and Users are encouraged to verify such details with the Merchant directly before making any transaction.

The platform does not involve itself in the delivery or transportation of goods or services. Therefore, any delivery services offered to Users are arranged directly between the local User and the local Merchant.

If a Merchant independently offers delivery services for products or services featured on the platform, ZamWays assumes no responsibility or liability for the delivery process, including but not limited to the timeliness, condition, or accuracy of the goods delivered.

2.1. Misconduct by Delivery Personnel

In the event that a User purchases a product or service from a Merchant and the Merchant, at their discretion, provides delivery services, ZamWays is not involved in, nor responsible for, the conduct of the delivery personnel. If a delivery person misbehaves with a User during the delivery of a product or service purchased from a Merchant featured on ZamWays, the User acknowledges that ZamWays bears no liability for such misconduct, as ZamWays does not provide delivery services nor does it employ or manage delivery personnel.

However, for the sake of maintaining a high standard of user experience and customer protection, ZamWays may take steps to review the incident and, if appropriate, take action against the delivery personnel or the Merchant. While ZamWays has no legal obligation in this regard, the Company may assist in escalating the matter to the Merchant or remove the delivery personnel from any involvement with the platform on humanitarian grounds.

ZamWays is not liable for any disputes or issues arising from non-fulfillment, delayed delivery, or misrepresentation of products/services by the Merchant.

3. User and Merchant Responsibilities

Users: It is the responsibility of the User to visit the Merchant's store and to communicate directly with the Merchant regarding their product or service needs, including any specific details related to the product’s condition, delivery options (if any), and any after-sales services.

Users are required to physically visit the Merchant's store to complete their purchase and obtain the items or services. In cases where the Merchant offers delivery services, it is the responsibility of the User to verify the details of that service directly with the Merchant prior to finalizing any transactions. ZamWays encourages Users to fully understand the terms of any delivery arrangement provided by the Merchant, including potential fees, timing, and delivery logistics.

Merchants: Merchants are solely responsible for the accuracy of the product descriptions, images, prices, and any other information displayed in the ZamWays app. Merchants are also responsible for handling refunds, exchanges, or any customer service-related issues.

4. Disclaimer of Liability

ZamWays does not assume any responsibility for interactions or disputes between Users and Merchants beyond providing a connection through its platform. The Company does not guarantee that the products or services listed on the platform are free from defects, misrepresentations, or inaccuracies. Furthermore:

ZamWays is not responsible for any delivery issues that may arise, including but not limited to non-delivery, late delivery, or unsatisfactory delivery by Merchants.

ZamWays is not liable for any misconduct by Merchants, including but not limited to unprofessional behavior, refusal of service, or failure to honor product/service listings. Users must report such issues directly to the Merchant, and ZamWays will not intervene in such matters.

5. Indemnity and Hold Harmless

By using the ZamWays platform, Users agree to indemnify, defend, and hold harmless ZamWays, its directors, employees, and affiliates from any claims, damages, losses, or liabilities arising from:

  • Any breach of the terms outlined in this No Delivery Policy.
  • Any issues related to the purchase, delivery, or return of goods or services facilitated by the Merchant.
  • Any injury, harm, or damage incurred during or after visiting a Merchant's store.

6. Merchant Data Accuracy

While ZamWays strives to maintain up-to-date and accurate listings of Merchant information, such as store details, contact information, and product/service availability, the accuracy of this data is solely the responsibility of the Merchant. ZamWays disclaims any liability for inaccurate or outdated information provided by Merchants and displayed on the platform.

7. Limitation of Liability

To the fullest extent permissible under applicable law, ZamWays will not be liable for any damages arising out of or in connection with the use of the platform, including but not limited to:

  • Loss of business, revenue, or profits.
  • Loss of data or anticipated savings.
  • Indirect, incidental, or consequential damages resulting from any reliance on the platform for the purchase of goods or services from Merchants.

8. Reporting Merchant Misconduct

While ZamWays has no legal responsibility for Merchant conduct, it is committed to providing a positive user experience. If a User encounters inappropriate behavior from a Merchant or other issues, they may report it to ZamWays. While we cannot resolve the matter directly, we may review the Merchant’s continued presence on our platform based on the severity of the complaint.

9. Amendments to this Policy

ZamWays reserves the right to amend this No Delivery Policy at any time without prior notice. Any changes will be posted on the platform, and continued use of the platform after such changes constitutes acceptance of the revised terms.

10. Governing Law and Jurisdiction

This No Delivery Policy is governed by and construed in accordance with the laws of India. Any disputes arising under this policy or in connection with the platform shall be subject to the exclusive jurisdiction of the courts located in Local Jurisdiction.

11. Acceptance of Terms

By using the ZamWays platform, Users acknowledge that they have read, understood, and agreed to the terms outlined in this No Delivery Policy.
